Privacy Policy
1. Gao Yue Securities Limited (the “Company”, “we“, “us” or “our”) is committed to providing quality securities services to its clients. We collect and use personal data from our customers based on the needs of our services. We recognise that our customers are concerned about the use and confidentiality of their personal data (“Data” or “Data“).
2. Protecting the security and privacy of customer data is something we take seriously. Therefore, we have established the following policy and are committed to complying with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong) (the “Ordinance“) to ensure the privacy, confidentiality and security of customer information.
3. If any of our operations are subject to any other privacy laws outside Hong Kong, this Statement will also apply to the extent that it does not contravene the relevant local laws.
4. For the purposes of the PDPO, a data subject is an individual who is a subject of the relevant personal data.
5. This Statement is subject to revision from time to time without prior notice and customers should check our website regularly for the latest version.
Personal Information Collection Statement
6. The Company collects such personal data from visitors to the website/app and is provided by the interviewee on a voluntary basis.
7. From time to time, individual customers are required to provide us with information, including personal identification information (such as name, age, occupation, marital status, email address, telephone number, personal identification data, electronic signature, address and other contact information, financial information, credit history, source of wealth, risk tolerance, investment experience and objectives, etc.), transaction history, account funds and securities position information, IP address, browser type and version, time zone setting, browser plug-in type, operating system or platform or device information (including IMEI of mobile devices, wireless network and general network data), etc., for the purposes described in privacy or sensitive personal data as defined by other relevant applicable laws and regulations.
8. We also collect information from our customers from publicly available information, the formation of unique internal identification numbers for compilation and reporting, the formation of internal statistical analysis data, access to our websites or applications, telephone recordings and/or communications using electronic media, or risk intelligence applications of third parties.

10. Data relating to our customers will only be used for lawful purposes of conducting our own business and for product design and offers, and customer data (and other information) may be used for the following purposes:
- to provide services or products to customers;
- To carry out the first and ongoing “Customer Identification” (KYC) due diligence process, verify the identity of our customers and comply with our obligations under anti-money laundering laws and regulations;
- carrying out certification services recognised under the Electronic Transactions Ordinance (Chapter 553 of the Laws of Hong Kong), such as those provided by certification authorities in Hong Kong or elsewhere (including but not limited to the PRC) for the purpose of verifying the identity of customers;
- processing applications for services made by the Client, for which the Client is a guarantor or for one or more other persons who provide third party security to them, or for the day-to-day operation of the provision of services to the Client or such persons;
- conducting credit checks, reconciliation procedures, information confirmation, due diligence and risk management;
- Assist other financial institutions in conducting credit checks and debt collection;
- ensuring the maintenance of reliable credit by the Customer or any guarantor;
- maintaining the credit history of the Client or any guarantor for present or future reference;
- designing financial services or related products for the use of clients (including, where appropriate, providing financial advice to clients);
- promote financial services or related products (see paragraphs 10-12 for further details);
- determine the amount of debt between the Client or any guarantor and us;
- collect amounts owed from the Customer or any guarantor;
- complying with requests or requests for disclosure of information made by law;
- to enable our actual or proposed assignee in the event of a merger, consolidation, reorganization or otherwise to evaluate the transaction to be transferred;
- any purpose permitted by law;
- commencing or defending or otherwise participating in any legal or administrative proceedings before any court or competent authority;
- complying with the requirements of the Code on Takeovers and Mergers and Share Repurchases issued by the SFC (as amended from time to time) and/or the statutory and/or regulatory rules in Hong Kong and/or elsewhere;
- any purposes relating to the above.
Use of Personal Data
11. We will keep the customer data (and other data) we hold confidential, but we may disclose such information in order to enable us to provide services, products, information and system updates to our customers, and we may not be able to provide services, products, information and system updates to customers if we fail to do so. We may disclose data (and other information) to:
- any officer, employee, agent, contractor or third party who provides administrative, credit, debt collection, telecommunications, computer, payment or other services to us in connection with the operation of our business (e.g. our IT service providers, electronic data storage service providers, biometric authentication service providers, etc.);
- persons who create, maintain, and test procedures and systems for customer data verification and due diligence;
- any Gaoyu Group company, including but not limited to holding companies or affiliates located in Hong Kong or elsewhere;
- any person who is or proposes to act as a guarantor;
- any person under a duty of confidentiality to us, including any person whom the High Yue Group Company has undertaken to keep such information confidential;
- any financial institution with which a customer has a transaction or proposes to deal with it;
- credit reference agencies and debt collection agencies (if a customer defaults on its debts);
- any actual or proposed assignee of us, or participant or sub-participant or assignee of our rights in relation to the Client;
- any person or entity or data recipient with whom we have established or propose to enter into any business relationship;
- any certification authority in Hong Kong or elsewhere (including but not limited to the PRC);
- in accordance with any applicable laws, regulations, rules or guidelines relating to the Automatic Exchange of Financial Account Data (CRS) or the Foreign Account Tax Compliance Act (FATCA) enacted by the United States of America in accordance with the relevant authorities in Hong Kong or elsewhere in accordance with the current and future implementation;
- any legal authority, regulator, government department, tax authority, law enforcement agency, administrative or statutory body, stock exchange or clearing house, or other self-regulatory or industry body or body in Hong Kong or elsewhere (including but not limited to the PRC).
12.We may share/use/transfer data relating to our customers (and other data) outside Hong Kong for the purposes set out in this Statement, and such data (and other information) may not be afforded the same or similar level of protection as under the laws of Hong Kong.

Use of data for marketing or direct marketing
13. We may use the data to send respondents information about products, services and other marketing promotions that the Company believes are relevant to their needs. We may also invite visitors to our websites/applications to participate in market research, opinion surveys and other similar activities. Customers may choose to receive marketing and other promotional materials by email. Customers who no longer wish to receive promotional materials by email or direct mail may also opt out of receiving such materials at any time.
14. We intend to use the customer’s personal data in direct marketing and we require the customer’s consent (which includes an indication of no objection) for this purpose. Part VIA of the Personal Data (Privacy) (Amendment) Ordinance 2012 introduces specific requirements for obtaining consent (including an indication of no objection) from customers. In this regard, customers are reminded that:
- the names, contact details, products and services, portfolio information, trading patterns and behaviour, financial background and statistical data of the Clients held by us from time to time may be used in direct marketing;
- The following categories of services, products and promotional slogans may be promoted:
– financial, insurance, securities, commodities, investment and related services and products and facilities;
– rewards, membership rewards or privileges programmes in relation to promotional slogan categories;
– the provision of services and products by our affiliates in relation to the promotional slogan category (the names of such affiliates will be provided on the application form for the relevant services and
products (as the case may be)); donations and funding for charitable and/or non-profit-making purposes; - The above services, products and promotional banners may be provided by us and/or solicited (in the case of donations and funding) by the following parties:
– any member of the Gao Yue Group;
– third-party financial institutions, underwriters, securities, commodities and investment service providers;
– third-party rewards, loyalty rewards, co-branding or privileges program providers;
– Our co-branding partners (the names of such co-branding partners will be provided on the application form for the relevant services and
products (as the case may be); charitable or non-profit making organisations; - In addition to self-marketing the above services, products and promotional slogans, we also intend to provide the above information to all or any of the above persons for use by such persons in marketing such services, products and promotional slogans (for which we may or may not be paid) and we are required to obtain the customer’s written consent (which includes an indication of no objection) for such purposes;
- If the Customer does not wish us to use or provide the Customer’s Data to other persons for the above direct marketing purposes, the Customer may exercise the Customer’s right to opt-out of direct marketing activities by notifying our Customer Service Department in writing.
15. We may, in accordance with the PDPO and other applicable laws, do the following:
- matching, comparing or exchanging any data or other information provided by or about the Customer with data (or other information) held by us or any other person for the following purposes:
– Credit review;
– to present or reconcile data (or other data) which may be used to take adverse action
against the Customer or any other person at any time;– transfer such data (or other data) to or elsewhere in Hong Kong (whether or not such or other data is processed, held or used outside Hong Kong).
Protection of Personal Data
16. We have security measures in place to protect our customers’ data from misuse or unauthorised access, alteration or destruction.
- We provide access to or use of information by authorised employees and agents in a secure manner (encrypting personal data where necessary) in accordance with the principle of “need to know“;
- We will not distribute information about our customers to any other person except for the purposes of conducting our business activities, complying with applicable laws, protecting against fraud, or making offers on products and services that we believe may be in the interests of our customers;
- The use of customer information between companies within the Gaoyu Group is subject to strict internal security standards, confidentiality policies, privacy ordinances and other applicable laws;
- We bind our employees to comply fully with these standards, policies and laws;
- We will provide relevant training to our staff on the proper handling of data.
17. As we further develop new products and services, we will continue to strive to ensure that our customers’ data is used correctly and appropriately protected.
Access and correction of data
18. Under and in accordance with the terms of the Ordinance, each customer has the right to:
- obtain information about the processing of data and request access to the data we hold about the data subject;
- Revoke your consent to our processing of their data at any time. Please note, however, that we are still entitled to process the data if we have other lawful grounds (other than those subject to consent);
- In certain circumstances, the right to receive certain data in a systematic, commonly used and computer-readable format and/or to request that we transmit such data to third parties where technically feasible. Please note that this right only applies to data provided to us by the data subject;
- the right to request that we correct the data if it is inaccurate or incomplete;
- In certain circumstances, the right to request that we delete the data. Please note that in certain circumstances, we are legally permitted to retain data even if the data subject asks us to delete it;
- In certain circumstances, the right to object and the right to request the restriction of our processing of data. Similarly, in certain circumstances, we may process the data and/or refuse the request in accordance with the law, even if the data subject objects to or asks us to restrict the processing of the data;
- If a data subject believes that we have violated his or her right to privacy of personal data, he or she has the right to lodge a complaint with the Personal Data Protection Supervisory Authority (see below for details);
- In the case of a customer’s personal credit history, you may request to be informed of the information that is routinely disclosed to the credit reference agency or collection agency and to obtain further information in order to request access and correction of the data from the relevant credit reference agency or collection agency;
- Upon full repayment of the delinquency and termination of the credit, the customer instructs us to request the relevant credit reference agency to delete any account data relating to the terminated credit from its credit database, provided that there is no material default within the five years preceding the termination of the credit (whichever we decide).
19. If there are any changes to the personal information provided to us by our customers, please contact our Customer Service Department at the email/mailing address set out below. We are not responsible for any invasion of privacy caused by a customer’s failure to notify us of the change. Retention of Personal Data
22. The retention period for personal data will vary from case to case and depend on different factors, including:
- Purpose of use – the data needs to be retained for as long as is necessary for that purpose; and
- Legal obligation – the minimum period for which data is retained by laws and regulations.
